 Chapter 22. ELECTIONS
 Article II. CITY COUNCIL DISTRICTS

  § 22-35. Territory not specified for inclusion in any district.

  • (a)

    Any portion of the city which is not stated in this article as being included in any district and which is entirely surrounded by a district shall be included within the surrounding district. Any portion of the city which is not stated in this article as being included in any district and which is contiguous to two or more districts shall be included within the contiguous district that contains the least population per city council member according to the United States Decennial Census of 2010; however, if the contiguous districts have equal populations, such portion shall be included within that contiguous district that has the lowest number designation.

    (b)

    Any portion of the county which is unincorporated on December 13, 2011, and which is subsequently annexed by the city shall, upon annexation, be administratively assigned by the city clerk to a city council district. The city clerk shall utilize the following rules to assign newly annexed territory to a city council district:

    (1)

    Newly annexed territory shall be assigned to the city council district to which it is contiguous.

    (2)

    In the event that newly annexed territory is contiguous to more than one city council district, the newly annexed territory shall be assigned to the city council district to which the greatest portion of said newly annexed territory's boundaries is contiguous.

    (3)

    If the newly annexed territory is not contiguous to the city, the newly annexed territory shall be assigned to the city council district to which it is most closely located in geographic distance calculated by direct line from the closest points of the boundary of the newly annexed territory and a city council district's boundary. In the event that the newly annexed territory is equally close by distance to more than one city council district, the newly annexed territory shall be assigned to the city council district that has the lowest number designation.

    (c)

    Periodically after newly annexed territories have been assigned to appropriate city council districts the city council shall adopt an ordinance amending boundaries of the city council districts specified by this article for the sole purpose of adding said newly annexed territories to the district descriptions.
